TERMS OF SERVICE
Welcome to Matt Anthony Photography. These Terms of Service ("Terms") govern your use of our photography services and website, located at https://mattanthonyphoto.com. By accessing our services, you agree to be bound by these Terms, including our Privacy Policy and Refund Policy, which are incorporated by reference. If you disagree with any part of the Terms, please do not use our services.
1. Services
Matt Anthony Photography provides professional photography services, including professional headshots, lifestyle photography, architectural photography, personal branding photography, and event photography. Detailed descriptions of the services offered can be found on our website or will be provided as part of your booking confirmation.
2. Booking and Payment
To book a photography session, clients must agree to pay any required deposits and fees as outlined in our Refund Policy.
Full payment of the agreed-upon service fee is due 7 days before the session date. Failure to complete payment may result in the cancellation of your booking.
3. Cancellation and Rescheduling
Please refer to our Refund Policy for details on cancellation and rescheduling. Cancellations or requests to reschedule must be made in writing via email or through our website.
4. Copyright and Usage Rights
Upon full payment, clients will receive specified usage rights to the photographs taken during the session, detailed in the service agreement. Unless otherwise agreed upon, Matt Anthony Photography retains copyright ownership of all images.
Clients are granted a non-exclusive, non-transferable license to use the photographs for personal, non-commercial purposes only, unless a commercial use license is separately purchased.
Matt Anthony Photography reserves the right to use any photographs for promotional purposes, portfolio, or other business uses, unless specifically agreed otherwise in writing.
5. Client Responsibilities
Clients agree to:
• Provide accurate and complete information necessary for the successful completion of the photography services.
• Ensure that any locations, permissions, or access required for the session are secured prior to the session date.
• Cooperate with Matt Anthony Photography during the session and follow any reasonable instructions.
6. Limitation of Liability
Matt Anthony Photography shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) our services.
7. Indemnification
You agree to defend, indemnify, and hold harmless Matt Anthony Photography and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
